At any stage of a proceeding if a party fails to satisfy the requirements for filing a Petition for Administrative Review; file a responsive pleading required by statute or rule; attend or participate in a prehearing conference, hearing, or other state of the proceeding; or take action on a matter for a period of sixty (60) days if the party is responsible for taking the action, the ELJ may serve upon all parties written notice of a proposed default or dismissing order, including a state of the grounds. Within seven (7) days after service of this order, the party may file a written motion, with reasons why, the order not be entered. If the party fails to meet these time requirements, the ELJ shall issue the order. Ind. Code § 4-21.5-3-24.
