Yes. The parties can discuss settlement at any time. Settlement discussions do not involve an ELJ, and the ELJ should not be informed of the content of settlement discussions. If the parties inform OEA that they are having settlement discussions, the ELJ will typically require the parties to file Status Reports periodically with OEA. Similar to the cases in Indiana’s superior or circuit courts, most cases before OEA settle.
