IC 36-1-3-4(b) states a unit (defined as a county, city, town, or township) has all the powers granted by statute and all other powers necessary or desirable in the conduct of its affairs, even though not granted by statute. To enact a power not already granted by the Indiana Constitution or statutory provisions, a city/town legislative body must adopt an ordinance to exercise the power – commonly referred to as a Home Rule ordinance as authorized by IC 36-1-3.
