It is illegal to provide alcoholic beverages to someone you believe to be intoxicated. The law does not make exceptions regarding the operation of a motor vehicle.
Providing alcoholic beverages to a person who is intoxicated is a class B misdemeanor. Upon conviction, a person may be imprisoned for a fixed term of not more than 180 days and fined not more than $1,000. The provider may experience civil liabilities if death and/or injury occur, even to a third party, as a result of this illegal act. In addition, an ATC permit may be revoked as a result of this offense.
