The Indiana Department of Insurance regulates the business of health insurance in Indiana. If an employer chooses to self-fund or self-insure its employee health plan, the state department of insurance usually does not have authority over that plan. These types of employee welfare benefit plans are directed by the U.S. Department of Labor under the Employee Retirement and Income Security Act (ERISA).
